DuoVox — Terms of Use

These Terms of Use ("Terms") govern your use of the DuoVox application ("App") provided by David Arthur Software ("DAS", "we", "our", "us"). Please read them before using DuoVox. In the App you accept them by ticking the box and choosing "Agree & Continue"; if you do not agree, choose "Decline & Exit" and the App will close. By installing or using the App you agree to these Terms.

1. What DuoVox is

DuoVox is a real-time voice transcription and translation application. It captures audio, transcribes speech to text, and provides AI-powered translation between supported languages. The App is a Windows desktop application distributed through the Microsoft Store.

DuoVox is an assistive tool that produces automated, real-time speech-to-text and translation. It is a software aid only. It is not a certified, verified, or human interpretation or translation service, and it does not replace a qualified human interpreter or translator. Using DuoVox does not create any interpreter–client, translator–client, or professional advisory relationship. DuoVox is not a medical device, is not regulatory-approved or certified for clinical, diagnostic, or treatment use, and is not intended for such use; its output is not a certified, sworn, or official translation or record.

2. Plans and Pay-As-You-Go

The App offers the following plans. The price for your country is shown in the Microsoft Store before you buy, in your own currency, and that is the price you pay. Current prices are also published at duovox.net. We describe here what each plan includes rather than repeating prices, so that this document cannot fall out of step with what the store actually charges.

How credits and included hours are used together depends on the quality of the session. If you have no active subscription, all usage is drawn from your credits. If you do have a subscription and the session runs at the quality your subscription includes, your included hours are used first and your credit balance is then drawn on automatically once they run out, with nothing for you to do. If a Professional credit balance lets you run at a higher quality than your subscription includes — for example a Standard subscriber using Professional hours — that session is funded entirely from your credit balance, and your included hours are not consumed until the credits are exhausted. AI features stop only once both your included hours and your credits are exhausted.

All paid plans are billed through the app store from which you bought the App, and are subject to that store's terms. The Standard annual plan costs less than paying monthly for twelve months, and the Professional six-month plan costs less than paying monthly for six months. The exact saving depends on the prices in your own currency, which the store shows you before you buy.

2a. Usage limits and continuation

Standard and Professional include a set number of AI usage hours per billing cycle. Your allowance is granted monthly, and it is granted monthly for every plan length — an annual or six-month plan gives you the same hours each month, not one month's hours for the whole term. Usage is measured as the time an AI transcription session is running, from the moment you start it until you stop it; time outside a running session is never counted.

The App will notify you at 80% and at 100% of your monthly hours. At 100% you may choose to continue at your subscribed quality level using Pay-As-You-Go credits, continue at the Free offline quality level (lower accuracy but no internet required) for the remainder of the session, or end the session and wait for your next billing cycle. The App will never automatically charge you beyond your subscription without your explicit confirmation.

Unused subscription hours do not carry over to the next billing cycle; purchased Pay-As-You-Go credits do not expire. If your included hours and your credits both run out during a live session, AI transcription and translation stop at that point; the App continues to work in Free offline mode.

3. Internet and cloud services

Paid features require an active internet connection and access to cloud-based AI services. AI transcription and translation are provided through third-party service providers. Service availability depends on both DuoVox infrastructure and third-party provider uptime.

When a session is served by AI — on a subscription, or on any session funded by Pay-As-You-Go credits — the audio of that session and the text produced from it leave your device and are processed by those providers in order to return a result. They are processed in real time and are not stored by us.

When a session runs in Free offline mode, transcription and translation run entirely on your machine and no audio, transcript or translation is sent anywhere. Note that "Free" describes the plan you are on, not necessarily how a given session runs: if you hold Pay-As-You-Go credits without a subscription, sessions funded by those credits are AI sessions and are processed as described above until your credits are exhausted.

Separately, and on every tier including Free, the App sends us a short summary at the end of each session: the app version, your tier, the session length, which speech engine served it and whether it fell back to a backup engine, counts of errors and of captions produced, suppressed or corrected, and summary measurements of your microphone signal quality such as signal-to-noise, level and clipping. These summaries never contain audio, transcripts or translations. They are sent with a randomly generated device identifier created and stored on your device; it is not linked to your name, but it does let us associate reports from the same installation. The App also sends crash reports containing the error type, the first line of the technical stack trace and the app version, and a note when a previous run did not shut down cleanly. All of this is described in full in the Privacy Policy.

4. Acceptable use

You agree to use the App only for lawful purposes. You must not:

4a. Consent for recording, and your assurance to us

You are responsible for obtaining any consent required to record, transcribe, or translate a conversation, including compliance with one-party or all-party consent laws in your jurisdiction. Consent requirements differ between countries, and between states or regions within them; it is your responsibility to know and follow the rules that apply where you are and where the other participants are.

By using the App to caption or translate a conversation, you confirm that you have the right to do so, and that you will tell the other people taking part where the law or the circumstances require it. This matters because on a paid tier the conversation is processed by a third-party provider, and the other participants have not agreed to these Terms — only you can obtain their consent, and only you know the circumstances.

5. Accuracy and limitations

Automated transcription and translation can be wrong. The output may contain errors, omissions, mishearings, mistranslations, or missing context, and its accuracy varies with audio quality, accents, background noise, terminology, and the languages involved. You must not rely on DuoVox as the sole or authoritative source of meaning in any medical, legal, safety-critical, financial, immigration, law-enforcement, or other high-stakes situation. Always verify anything important by other means. If you act as an interpreter or translator, you remain professionally responsible for the accuracy and completeness of your work. You are responsible for verifying any output before relying on it or acting upon it.

6. Intellectual property

The App, including its code, design, icons, and documentation, is the intellectual property of David Arthur Software. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal or business purposes in accordance with these Terms.

7. Third-party services

The App relies on third-party services for AI processing and, on some platforms, advertising. These services have their own terms and privacy policies. Third-party AI providers may keep limited operational logs under their own privacy policies, which can change without notice; see our Privacy Policy for details. DAS is not responsible for the availability, accuracy, or conduct of third-party services. Service interruptions by third-party providers may affect App functionality.

8. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DAS does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, DAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

To the fullest extent permitted by law, the total aggregate liability of David Arthur Software and its suppliers to you for all claims arising out of or in connection with DuoVox or these Terms will not exceed the greater of (a) the total amount you paid for DuoVox in the 12 months before the event giving rise to the claim, or (b) GBP 50. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for any other liability that the law does not permit to be excluded. Nothing in these Terms affects your statutory rights as a consumer.

10. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to suspend or terminate access to the App if you violate these Terms. Upon termination, all locally stored data remains on your device until you delete it.

10a. Cancellation and refunds

You may cancel your subscription at any time through the app store from which you purchased it. Upon cancellation, you retain access to paid features until the end of your current billing period. Refunds are handled by the respective app store in accordance with their refund policies. If you believe you are entitled to a refund for unused subscription time, please contact us at info@duovox.net and we will review your request on a case-by-case basis.

11. Changes to these Terms

We may update these Terms from time to time. Changes are reflected by updating the version and "last updated" date at the top. Where a change is material you will be asked to review and accept the updated Terms before continuing to use the App. Your continued use of the App after a change constitutes acceptance of the updated Terms.

The copy shown inside the App is the version you accepted, identified by the version number at the top. The current version is always published at duovox.net/terms.

12. Language

These Terms may be displayed in the language you have selected. The English version is the reference version. If you are a consumer and the mandatory law of your country of residence requires a version in your local language to prevail, that version will prevail in the event of any conflict; otherwise the English version prevails.

13. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction. If you are a consumer you may also be entitled to bring proceedings in the courts of your country of residence.

14. Privacy

Our Privacy Policy forms part of these Terms and is published at duovox.net/privacy. DuoVox is an assistive aid: when you use AI transcription or translation, audio is processed in real time to produce text and is not stored by us once it has been processed. You are responsible for obtaining any consent required to record, transcribe, or translate other people, and for using the App in accordance with the laws that apply to you. Where David Arthur Software processes personal data, it does so in accordance with that policy and applicable data-protection law and retains its own data-protection responsibilities.
